Penalties for 1st, 2nd, and 3rd DUI, as well as DUI Manslaughter, DUI and Drugs and Other Offenses

  • Jail time: Up to 6 months
  • Fines: Up to $500 for BAC between .08% to .19%, or $1,000 for .20% or higher, or child in vehicle.
  • 50 hours of mandatory community service.
  • Probation up to 1 year.
  • 10 day vehicle impoundment
  • 6 months driver's license revocation (minimum)

Second Time DUI - Misdemeanor

  • Jail time: Up to 9 months (minor in car or BAC at .20% or higher, 1 year)
  • Fines: Up to $1,000 for BAC between .08% to .19%, or $2,000 for .20% or higher, or child in vehicle.
  • 50 hours of mandatory community service.
  • Probation up to 1 year.
  • 30 day vehicle impoundment
  • 6 months minimum driver's license revocation (minimum)

Third Time DUI - Misdemeanor or Felony

  • Felony charges if 3rd DUI offense within 10 years.
  • Jail time: Up to 12 months (minor in car or BAC at .20% or higher, 1 year)
  • Fines: Up to $2,500 (or $5,000 if a third conviction within 10 years)
  • 50 hours of mandatory community service.
  • Probation up to 1 year.
  • 90 day vehicle impoundment
  • Driver's license revocation for 5 years, for 3rd conviction in 10 years, 10 years license revocation.

Fourth or More DUI -- Felony

  • Jail time up to 5 years.
  • Fines of $2,000 and no maximum fine - can be increased.
  • Permanent license revocation.

DUI Manslaughter -- Felony

  • Up to 15 years in state prison. Up to 30 years in leaving the scene.
  • Up to $10,000 in fines.
